Overview#
These Terms of Use (“Terms”) govern your access to and use of Eire Drive (the “App”), made and maintained by MyLabs Ireland, a subsidiary of Austin Study Labs LTD (“we”, “our”, or “us”). By creating an account or using the App, you agree to these Terms. If you don’t agree, please don’t use the App.
These Terms work alongside our Privacy Policy, which explains how we collect and handle your data. If there’s ever a conflict between the two on a privacy matter, the Privacy Policy governs; on everything else, these Terms govern.
Eligibility#
Eire Drive is intended for learner drivers aged 17 and over. By creating an account, you confirm that you meet this age requirement. We do not knowingly allow use by children under 17, and we may suspend or terminate any account we reasonably believe belongs to someone younger.
Your Account#
- You need an account to use the App’s quiz and test-history features, created with an email and password, or by signing in with Google or Apple.
- You’re responsible for keeping your sign-in credentials secure and for all activity that happens under your account.
- Keep your account information accurate — you can update your email from inside the App.
- One account per person. Don’t create accounts on behalf of someone else without their permission, or share your account with others.
The App's Content Is Educational, Not Official#
Eire Drive is not affiliated with, endorsed by, or connected to the Road Safety Authority (RSA) or any official Irish government testing body. The practice questions, mock tests, and any other content in the App are provided for educational and practice purposes only.
We do our best to keep questions accurate and up to date, but we don’t guarantee that App content matches the current official theory test in every respect, and we’re not responsible for outcomes on your actual test.
Readiness Estimate
The App may show you a personal estimate of how ready you are for your theory test, generated automatically from your own saved answers. This estimate:
- is shown only to you — no one else sees it or uses it to make any decision about you;
- is an educational guide, not a prediction or guarantee of your official test result;
- should not be relied on as the sole basis for deciding whether to sit your test.
Tips#
The App lets you leave an optional tip to support development, processed entirely through Apple’s in-app purchase system. We never see or store your payment card details — see our Privacy Policy for what we do record about a tip (which tip, its price, Apple’s transaction ID, and the date).
- Tips are optional and don’t unlock any App feature or change your level of service.
- All purchases are billed and refunded through Apple, subject to Apple’s own refund policies. We can’t issue refunds directly.
Feedback#
If you use Share Feedback in the App, you grant us the right to use what you send to fix bugs, understand problems, and improve the App. Please don’t include information you wouldn’t want us to hold beyond what’s needed to describe the problem — see the Privacy Policy for more on this.
Acceptable Use#
When using Eire Drive, you agree not to:
- reverse engineer, decompile, or attempt to extract the source code of the App, except where applicable law gives you the right to do so;
- scrape, harvest, or bulk-extract question content or other App data;
- interfere with or disrupt the App, its servers, or the accounts of other users;
- use the App for any unlawful purpose, or to impersonate another person;
- attempt to circumvent any access, security, or account restriction in the App.
We may suspend or terminate your account if we reasonably believe you’ve broken these Terms.
Ending Your Account#
You can delete your account at any time from inside the App (Account → Delete Account), or by emailing us — see the Privacy Policy for details on how deletion works and what it removes.
We may suspend or terminate your access to the App if you violate these Terms, if we discontinue the App, or if we’re required to do so by law. Where reasonably possible, we’ll try to give you notice first.
Intellectual Property#
The App, including its design, question content, branding, and underlying software, is owned by MyLabs Ireland / Austin Study Labs LTD or our licensors and is protected by copyright and other intellectual property laws. These Terms don’t grant you any right to use our name, logos, or branding.
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use the App on your own devices for your personal, non-commercial use.
No Warranty#
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the App will be uninterrupted, error-free, or that its content is complete or accurate, or that using it will result in passing any official test.
Nothing in these Terms excludes or limits any statutory right you have as a consumer under Irish or EU law that cannot lawfully be excluded.
Limitation of Liability#
To the fullest extent permitted by law, MyLabs Ireland and Austin Study Labs LTD will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App — including any outcome of your official theory test. Where liability cannot be excluded, our total liability to you for any claim relating to the App is limited to the amount (if any) you’ve paid us in tips in the 12 months before the claim arose.
Changes to These Terms#
We may update these Terms from time to time. We’ll update the “Last Updated” date above when we do. Continuing to use the App after a change means you accept the updated Terms.
Governing Law#
These Terms are governed by the laws of Ireland. Any dispute arising from these Terms or your use of the App will be subject to the exclusive jurisdiction of the courts of Ireland, without prejudice to any mandatory consumer-protection rights you have in your own country of residence.
